Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Building Cost Indices online resource ("the Resource"), provided by the Cost Indices Committee of the Institute of Quantity Surveyors of Kenya ("IQSK," "we," "us," or "our"). By accessing or using the Resource, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Resource.

  1. Acceptance of Terms: By accessing or using the Resource, you agree to these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific features or services offered within the Resource.

    • Data Collection: We may collect construction cost information provided by users of the Resource. This information may include but is not limited to project costs, material costs, labour costs, and other relevant data related to construction projects.
    • Purpose: The collected construction cost information will be used to prepare building cost indices by the Cost Indices Committee of the Institute of Quantity Surveyors of Kenya. These indices aim to provide insights into trends and fluctuations in construction costs over time.
    • Anonymization: Any construction cost information collected from users will be anonymized and aggregated to ensure the privacy of individual contributors.
    • Confidentiality: We will treat all construction cost information collected with the utmost confidentiality and will not disclose individual project details or identifiable information without prior consent, except as required by law.
    By using the Building Cost Indices online resource, you acknowledge and agree to the collection and processing of construction cost information as described in this clause. If you do not agree with any part of this clause, you must not provide construction cost information through the Resource.
  6. Intellectual Property: The Resource and its entire contents, features, and functionality are owned by IQSK and are protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the Resource without prior written consent from IQSK.
  7. Third-Party Links: The Resource may contain links to third-party websites or resources. These links are provided for your convenience only, and we have no control over the content or availability of such sites or resources. We are not responsible for any damages or losses incurred as a result of your use of any third-party website or resource.
  8. Disclaimer of Warranties: The Resource is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. IQSK disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  9. Limitation of Liability: In no event shall IQSK, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use or inability to use the Resource.
  10. Indemnification: You agree to indemnify and hold IQSK and its officers, directors, employees, and agents harmless from any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of the Resource or violation of these Terms.
  11. Modification of Terms: We reserve the right to modify these Terms at any time, in our sole discretion. If we make material changes to these Terms, we will notify you by email or by posting a notice on the Resource. Your continued use of the Resource after the effective date of any such changes constitutes your acceptance of the modified Terms.
  12. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.
